More than twenty (20) Emirati citizens were recently sent to early retirement by the Ministry of Education in the United Arab Emirates (UAE) under the "public interest" section of the Human Resources (HR) law issued by federal decree No. 11 for the year 2008. Managers of educational zones received official notifications from the ministry requiring the enforcement of the decision of the Ministerial Council of Services to terminate the services of those employees. The notifications did not list explicit reasons for the termination. Instead, it referred to section (1\/101) of the aforementioned decreed law which pertains to "public interest". (See the attached letter issued by the acting manager of the Ministry of Education). <\/span><\/div>\n

Affected by the sudden decision are more than twenty (20) male and female emirate employees, whose positions include school managers, assistant managers and educational consultants. The decision by the UAE cabinet carried out based on an employee list submitted by the Ministry of Education, despite that some of the ministry officials earlier informed the affected employees that the request of the termination came from outside the ministry – alluding therefore to the UAE State Security Agency.  Moreover, some ministry officials have expressed their disbelief with the decision, since most of the affected employees are amongst the most qualified and highest performing educational and managerial staff in the ministry, whose efforts has been recognized by excellence awards on the ministry and national level. The termination occurred despite the shortage of qualified national educators in the ministry in general and especially in male educators, according to an earlier statement by some ministry officials. <\/span><\/div>\n

It is worth mentioning that this decision is not without precedent; as the ministry has previously terminated the services of 83 of its teachers and employees approximately three years ago, due to what believed to be related to their islamist background. The affected employees staged a protest in front of the Ministry headquarter, which was not overlooked by the local press and covered extensively by the international press and the Internet. The termination decision also elicited condemnations from several international organizations. The authorities usually carries out these decisions during summer holidays and informs the affected employees when they are about to resume their duties with the beginning of the new school year. <\/span><\/div>\n

The federal decree containing the HR law No. 11 for the year 2008, which was issued during the recess of the Federal National Council (FNC) – (the parliament, which is partially elected indirectly and partially appointed) –  gives the UAE cabinet the power to terminate the services of government employees for reasons pertaining to "Public Interest", which amended the civil service law issued in 1999 which was explicitly listing the reasons for terminations and therefore constrained the power of the government and protected the rights of its employees. Several of those employees whose services were previously terminated
\n were able to challenge these decisions in courts and resume their old jobs. Observers believe that the government intentionally passed the law during the FNC recess to avoid any criticisms from its members to some of the articles in the law, such as the "public interest" article and others, which could lead the government to unfairly fire employees.  <\/span><\/div>\n
